In the event of any conflict between these Terms and your mandatory statutory rights, your statutory rights shall prevail.

By accessing or using the Website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms"), together with our Privacy Policy and any other policies referenced herein.
If you do not agree to these Terms, you must not use the Website or place any orders.
These Terms apply to all users of the Website, including browsers, registered account holders, and customers who complete purchases.
We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on the Website with a revised date. Your continued use of the Website after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Website.

We sell physical goods through the Website and ship worldwide. All orders are subject to availability.
We make every reasonable effort to display product descriptions, images, colours, and specifications as accurately as possible. However, we cannot guarantee that your device's display accurately reproduces the appearance of our products. Minor variations in colour or finish do not constitute a defect.
We reserve the right to:
- Limit the quantities of any product available for purchase;
- Discontinue any product at any time without notice;
- Restrict sales to certain geographic regions or individuals where required by law or for legitimate business reasons.

6. Orders and Contract Formation
When you place an order on the Website, you are making an offer to purchase the selected products at the stated price. A binding contract between you and Digital Smak Sp. z o.o. is formed only when we send you an order confirmation email confirming that your order has been accepted and dispatched.
We reserve the right to refuse or cancel any order at our discretion, including where:
- A product is out of stock or no longer available;
- There is an error in the product description or price;
- We suspect fraudulent, abusive, or unauthorised activity;
- An order appears to be placed for resale or commercial redistribution without our prior written consent.
If we cancel your order after payment has been taken, we will issue a full refund using the original payment method within 14 days.
7. Prices and Payment
All prices displayed on the Website are in [insert currency] and are inclusive of VAT where applicable. Shipping costs are displayed separately at checkout before you complete your order.
We reserve the right to modify prices at any time. The price applicable to your order is the price displayed at the time you complete checkout, subject to correction of manifest errors.

We do not store your full card details. All payment data is transmitted directly to and processed by our payment provider in accordance with PCI-DSS standards.

8. Pricing Errors and Inaccuracies
Despite our best efforts, errors in pricing or product information may occasionally occur on the Website. We reserve the right to correct such errors at any time, including after an order has been placed.
If a pricing error is identified before your order is dispatched, we will contact you to offer you the option of:
- Confirming the order at the correct price; or
- Cancelling the order for a full refund.
If we are unable to contact you, we will cancel the order and issue a full refund. We are under no obligation to fulfil an order at an incorrect price.
9. Shipping and Delivery
We ship physical products worldwide. Estimated delivery times and shipping costs are displayed at checkout. Delivery times are estimates only and are not guaranteed. We are not liable for delays caused by customs procedures, local postal services, force majeure events, or other circumstances beyond our control.
Risk of loss and title to the products passes to you upon delivery to the address specified in your order. You are responsible for providing accurate shipping information. We are not liable for non-delivery or loss resulting from an incorrect address provided by you.
For international orders, you may be responsible for import duties, customs fees, and local taxes imposed by your country. These charges are your sole responsibility and are not included in the product price or shipping fee.
10. Right of Withdrawal and Returns
10.1 Statutory right of withdrawal (EU/EEA/UK consumers)
If you are a consumer resident in the European Economic Area or the United Kingdom, you have a statutory right to withdraw from your purchase without giving any reason within 14 calendar days from the day on which you, or a third party nominated by you (other than the carrier), receive the goods (the "Withdrawal Period").
To exercise your right of withdrawal, you must notify us of your decision before the expiry of the Withdrawal Period by sending a clear written statement to info@ecclesiashop.com. You may use the model withdrawal form set out in Annex A to these Terms, but this is not mandatory.
You must return the goods to us without undue delay and in any event no later than 14 days from the date on which you notified us of your withdrawal. The direct cost of returning the goods is borne by you, unless we agree otherwise.
We will reimburse all payments received from you, including standard delivery costs (but not any additional costs arising from your choice of a delivery method other than our standard option), without undue delay and no later than 14 days from the day on which we receive the returned goods or evidence that they have been sent back. We will use the same payment method you used for the original transaction, unless you expressly agree otherwise.
We may withhold reimbursement until we have received the goods or you have supplied evidence of having sent back the goods, whichever is earlier.
10.2 Condition of returned goods
You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods. Please return goods in their original packaging where possible, unused and in a resalable condition.
10.3 Exceptions to the right of withdrawal
The right of withdrawal does not apply to:
- Goods that have been clearly personalised or made to your specifications;
- Sealed goods that are not suitable for return due to health or hygiene reasons and were unsealed after delivery;
- Goods that have become inseparably mixed with other items after delivery.
10.4 Returns outside the EU/EEA/UK
For customers outside the EU/EEA and UK, returns are accepted within 14 days of delivery at your cost. Goods must be unused and in their original condition. Refunds will be issued within 14 days of receipt of the returned goods, less any applicable shipping or restocking costs.
11. Legal Conformity Guarantee (EU/EEA/UK Consumers)
If you are a consumer resident in the EU/EEA or UK, you benefit from a mandatory legal guarantee of conformity for physical goods under the EU Sale of Goods Directive (2019/771/EU) and applicable national law, including Polish consumer protection legislation.
Under this guarantee:
- Goods must conform to the contract of sale at the time of delivery;
- Any lack of conformity that becomes apparent within 2 years of delivery is presumed to have existed at the time of delivery (unless we prove otherwise);
- If goods do not conform, you are entitled to repair, replacement, a price reduction, or a full refund, in accordance with the applicable law.
To report a conformity issue, please contact us at info@ecclesiashop.com with your order number and a description of the defect. We will respond promptly and work to resolve the issue in accordance with your statutory rights.
This legal guarantee is in addition to, and does not affect, any commercial guarantee we may offer.
12. Intellectual Property
All content on the Website, including but not limited to the Ecclesia brand name and logo, text, images, graphics, product descriptions, software, and the overall look and feel of the Website, is the exclusive property of Digital Smak Sp. z o.o. or its licensors, and is protected by applicable intellectual property laws including copyright, trademark, and trade dress law.
You may not copy, reproduce, distribute, transmit, display, publish, modify, or create derivative works from any content on the Website without our prior written permission. Unauthorised use of our intellectual property may constitute an infringement and give rise to legal liability.
Nothing in these Terms grants you any licence or right to use our trademarks, brand names, or logos.
13. Prohibited Uses
You agree not to use the Website or its content:
- For any unlawful purpose or in violation of any applicable local, national, or international law or regulation;
- To infringe upon or violate our intellectual property rights or those of third parties;

You represent and warrant that your User Content:
- Is your own original work or you have the necessary rights and permissions to submit it;
- Does not infringe any third-party intellectual property, privacy, or other rights;
- Is not defamatory, offensive, unlawful, or otherwise objectionable.
We reserve the right to remove any User Content that we determine, in our sole discretion, violates these Terms or is otherwise inappropriate, without prior notice.

We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. 16. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Website and its content are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Website will be uninterrupted, error-free, or free of viruses or other harmful components;
- The results obtained from use of the Website will be accurate or reliable;
- Any errors on the Website will be corrected.
IMPORTANT FOR EU/EEA/UK CONSUMERS: The above disclaimer does not apply to the mandatory legal guarantee of conformity described in Section 11, nor does it affect any other statutory rights you may have as a consumer under applicable law. Your statutory rights are not affected.
17. Limitation of Liability
To the maximum extent permitted by applicable law, Digital Smak Sp. z o.o., its directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the Website or the purchase of products, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you in respect of any claims arising under or in connection with these Terms shall not exceed the total amount paid by you for the products giving rise to the claim.
IMPORTANT FOR EU/EEA/UK CONSUMERS: Nothing in these Terms limits or excludes our liability for: (i) death or personal injury caused by our negligence; (ii) fraud or fraudulent misrepresentation; (iii) any liability that cannot be excluded or limited under applicable mandatory consumer protection law. Your statutory rights as a consumer are not affected.
18. Indemnification
You agree to indemnify, defend, and hold harmless Digital Smak Sp. z o.o. and its affiliates, officers, directors, employees, agents, and suppliers from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (i) your breach of these Terms; (ii) your violation of any applicable law or regulation; or (iii) your infringement of any third-party rights.
19. Governing Law and Dispute Resolution
19.1 Governing law
These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
19.2 Jurisdiction
Subject to Section 19.3 below, any disputes arising out of or in connection with these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the competent courts of Poland.
19.3 Consumer dispute resolution (EU/EEA/UK)
If you are a consumer resident in the EU or EEA, you have the right to submit a complaint to the competent consumer protection authority in your country of residence, and to use alternative dispute resolution (ADR) procedures available in your jurisdiction.

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by an authorised representative of Digital Smak Sp. z o.o.
22. Entire Agreement
These Terms, together with our Privacy Policy and any other policies incorporated by reference, constitute the entire agreement between you and Digital Smak Sp. z o.o. with respect to your use of the Website and supersede all prior agreements, communications, and understandings, whether oral or written.
